HOSTING TERMS and CONDITIONS

Terms & Conditions of Service:
  1. This agreement is between Relax Web Productions, ("Relax Web"), and Client, to provide Web Hosting Services ("Hosting"). Relax Web Productions, LLC., shall provide all hosting, billing and customer service to Client for the duration of this agreement.

  2. All hosting fees are due automatically on the first day of the Billing Period. For Clients that exceed their monthly Space or Traffic Allowance ("Allowance"), Relax Web reserves the right to bill the customer an additional $10.00 per month for each 1,000 megabytes of data transfer (1 GB). Relax Web, however, will not bill Client without prior notice. Client will then have the option of continued service with the transfer rate surcharge, Client can request to upgrade their service, or Client can request that their service be canceled. Please refer to our pricing schedule for our current hosting rates. Additional storage space is available at $5.00 per 10 megabytes. Relax Web Productions reserves the right to change pricing within twenty (20) days notice by e-mail or posting to RelaxWeb.com.

  3. Relax Web will provide the hardware and system administration necessary to provide World Wide Web access to the Internet community. Included in your set-up fee, is the cost for Domain Name Registration as a Free Service. Relax Web will register domain name and assign it to Client's Name, on their behalf. Client understands that domain name registration can take up to 72 hours to process or longer. Relax Web will, however, provide a temporary working address to the Client's pages. Client also agrees to pay the domain name renewal fee directly to Network Solutions, or other appropriate domain name registrar (currently $35.00/year after 1st year). This fee is subject to change by Network Solutions or other domain name registrar. Neither Network Solutions, VeriSign, Thawte, or CyberCash is related in any way to Relax Web. Their rates and policies are subject to change without notice. Unless otherwise noted and agreed upon in writing by Relax Web, Client shall use this account to represent only one named organization or company.

  4. Client understands and agrees that Relax Web will make every effort to keep it's network of servers running continuously. However, their servers will, from time to time, be disconnected due to routine maintenance, upgrades, and other required or unforeseen events. Relax Web will make every effort to keep all information on it's servers backed-up. However, Client assumes responsibility for making a separate back up of any information posted to Relax Web's servers. Relax Web is not responsible for lost materials or information. Relax Web will also make every effort to maintain security on it's network of servers. However, the nature of the Web and the Internet is not secure by default. Customer assumes responsibility for the appropriate use of security within the Client's scripts and directories. Perl, Java, CGI, PHP and MySQL scripts are the only scripts supported by Relax Web. All CGI scripts require approval by Relax Web. Information forwarded from out Secure Servers that does not use SSL will not be as secure as information forwarded using SSL.

  5. RELAX WEB PROVIDES SERVICES TO CLIENT ON AN "AS IS" BASIS. RELAX WEB AND ANY ASSOCIATED SERVICE PROVIDERS EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES, INCLUDING THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. RELAX WEB SHALL NOT BE LIABLE FOR ANY LOSS OF BUSINESS, LOST PROFITS, LOST DATA, LOST SAVINGS, FAILURE OF SECURITY, OR ANY OR ALL INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, HOWEVER CHARACTERIZED, WHETHER OR NOT SUCH DAMAGES ARE FORESEEABLE.

  6. Client assumes full responsibility for all content posted to Relax Web's servers on Client's behalf, including any trademark, copyright, patent or other intellectual property submitted to Relax Web for either creative services and/or straight posting to our servers. Relax Web reserves the right to remove, without notice, any material which, in its sole opinion, may result in a violation of intellectual property rights of others or any other applicable Federal, State, Common, or International laws or regulations.

  7. Relax Web does not tolerate e-mail spamming or similar abuses of its network. Any client that uses their domain hosted on Relax Web servers to send Unsolicited E-Mail, Bulk Newsgroup Postings, or any other mass electronic marketing techniques in violation with this policy shall have their account terminated and shall forfeit any accrued pre-paid hosting fee balance.

  8. This agreement shall be governed by the law of the State of Missouri. The forum for any disputes under this agreement shall be Boone County, Missouri.

  9. RELAX WEB RESERVES THE RIGHT TO IMMEDIATELY TERMINATE ANY CLIENT THAT PERSONALLY, VERBALLY or PHYSICALLY ASSAULTS ANY RELAX WEB EMPLOYEE, OFFICER or OWNER. ANY AND ALL RELAX WEB SERVICES SHALL BE IMMEDIATELY TERMINATED. ANY FEES PAID FOR SAID SERVICES SHALL NOT BE SUBJECT TO ANY REFUND.

  10. Relax Web and Client, may cancel this agreement at will at any time with 10 days written notice. All sales are final. Prepaid fees are not subject to refund should client violate any terms and conditions herein. Domain Name registration and any set-up fees are non-refundable. Client acknowledges that these terms and conditions are subject to change without notice. Client's continued use of Relax Web constitutes customer acceptance of these and any and all modified terms.

By completing a transaction with Relax Web, I Acknowledge and Accept in full these Terms and Conditions of Service.
